Parties

This membership agreement has been mutually accepted and entered into force by electronic approval of the "Member" during registration on www.maisonavf.com (hereinafter referred to as the "Site").

By electronically approving the membership agreement while registering on the Site, the User acknowledges, declares, and undertakes that they have read the entire Membership Agreement, fully understood its content, and accepted all its terms.

Definitions

The company operating the www.maisonavf.com website, located at Adakent Cd. Beyaz City Çarşı No:4 İç Kapı No: 45, Beylikdüzü/Istanbul, MAISONAVF DEKORASYON ÜRÜNLERİ TİC. LTD. ŞTİ. (hereinafter referred to as the "Seller").

• Site: The online platform accessible within the framework determined by www.maisonavf.com, where various services and content are offered.
• Member: A natural or legal person who registers on the Site and benefits from the Services provided under the terms specified in this agreement.
• Buyer: A Member who purchases goods and/or services offered for sale on the Site.
• User: Any person visiting the www.maisonavf.com website, whether making a purchase or not.
• Approval Process: The process required for activating the membership by the User via a message sent from www.maisonavf.com.
• Website Terms of Use and Membership Agreement: This contract is electronically concluded between www.maisonavf.com and real and/or legal persons who will benefit from the commercial and personalized services offered through the Site.

Subject and Scope of the Agreement

The subject of this Membership Agreement is to determine the Services provided on the Site, the conditions for benefiting from these Services, and the rights and obligations of the parties.

The scope of the Membership Agreement includes this contract and its annexes, as well as all warnings, texts, and explanations published by the Seller regarding the use, membership, and Services on the Site. By accepting the terms of the Membership Agreement, the Member also acknowledges and accepts all statements issued by the Seller regarding the use, membership, and Services on the Site. The Member agrees, declares, and undertakes to act in accordance with all these statements.

The www.maisonavf.com website generally provides electronic commerce services as defined in Consumer Protection Law.

The Seller is free to determine the scope and nature of the Services it will provide through the Site and is deemed to have implemented any changes by publishing them on the Site.

To benefit from the Services offered on the Site, Users must meet the criteria specified by www.maisonavf.com and outlined in the relevant section of the Site. The Seller is free to determine these criteria and is deemed to have implemented any changes by publishing them on the Site.

Membership and Service Usage Conditions

Membership is completed when a person wishing to become a Member submits the necessary identity information via the relevant section of the Site and the Seller approves the registration process. Until the membership process is completed, the rights and authorities of being a Member as defined in this agreement cannot be acquired.

To become a member of the Site, one must be legally competent, and for legal entity members, the person must have the authority to represent and bind the entity. Individuals who have been temporarily or permanently banned from membership by the Seller within the scope of this agreement cannot become members. Even if such individuals complete the registration process, they cannot exercise the rights granted by membership.

The Seller may unilaterally terminate this agreement at any time without reason, notification, or compensation and immediately deactivate the Member's membership or temporarily suspend it.

The Seller's termination, suspension, or deactivation of membership decisions will be made based on violations of this agreement, violations of Site rules, security risks identified by the Seller's information security system, commercial considerations, or legal risks assessed by the Seller.

Rights and Obligations

Member Rights and Obligations

The Member acknowledges, declares, and undertakes to comply with all terms of this Membership Agreement, the rules specified on the relevant parts of the Site, and all applicable legislation while completing membership procedures, using the Site’s Services, and conducting any transaction related to these Services.

The Member accepts that the Seller has the right to disclose their confidential/private/commercial information to official authorities or rightful persons if required by mandatory legal provisions or in the case of claims of rights violations by other members or third parties. The Member agrees that they cannot claim compensation from the Seller in such cases.

The security, storage, confidentiality, and unauthorized use of the access tools (e.g., username, password) used by Members to benefit from the Services provided by the Seller are entirely the responsibility of the Members. The Seller is not liable for any direct or indirect damages suffered by Members or third parties due to security breaches, negligence, or unauthorized use of these access tools.

Members declare and undertake that the information and content they provide on the Site are accurate and lawful. The Seller is not obliged or responsible for verifying the accuracy of such information and content, ensuring its safety, or guaranteeing its legality.

Members cannot transfer their rights and obligations under this Membership Agreement to any third party without the Seller’s written consent.

The Members acknowledge that they will not engage in any activity on the Site that is illegal, contrary to public order, or violates third-party rights.

The Seller is not responsible for services and content provided by third parties on the Site. The accuracy and legality of any information, content, visual or audio elements published by third parties are entirely the responsibility of the respective providers.

The Member accepts that the Seller may share membership information with relevant parties for marketing, advertising, and promotional purposes within the scope of campaigns and sweepstakes conducted through the Site.

Buyer Rights and Obligations

The Buyer accepts the terms and procedures specified by the Seller by requesting to purchase the listed product.

The Buyer acknowledges that the Seller is not responsible for the authenticity, quality, legality, or any other characteristics of the products listed on the Site by the Seller.

The Buyer cannot hold the Seller responsible if a product is not delivered due to the Seller’s inability to provide it for any reason.

The Buyer agrees that the Seller will prepare a pre-information form and a distance sales contract within the Secure Shopping System in accordance with the Consumer Protection Law.

Seller Rights and Obligations

The Seller reserves the right to change, restrict access to, or remove any content and services provided on the Site at any time without prior notice.

The Seller may use the membership information for marketing, promotional, and statistical purposes and store it in a database.

The Seller does not act as an arbitrator or mediator in disputes between Members.

The Seller may review and remove content or messages that violate Site rules, general morality, or applicable laws.

The Membership Agreement continues in full force and effect until either party terminates it.
